Puppy Deposit Policy/Agreement
-------------------------------------------------------------------
1. It is the Policy of Matthew and Diane Raudenbush, aka/dba, Gunslinger Mastiffs, that a $500 (FIVE HUNDRED DOLLAR) deposit be made to reserve a puppy for the Buyer. This deposit will be deducted from the total amount due for the puppy when the puppy is placed with you.
2. All deposits are fully refundable up to the prospective puppy's date of birth. Once the agreed-upon puppy has been born, the deposit will be conditionally refundable*** within 3 days from communication of birth, provided the agreed upon puppy is available. It is agreed that e-mail from Matthew or Diane Raudenbush is an acceptable form of communication to satisfy the communication requirement.
3. If the agreed upon puppy is not available (e.g., color and sex preference not born - or not enough born given demand and order of waiting list), the puppy buyer has the right to a full refund of the deposit, or the selection of another available puppy. This decision is the sole decision of the puppy buyer. If the puppy buyer chooses an alternate puppy, the selection will be subject to paragraph 2 (two) above.
4. This Policy covers all agreements and deposits received for a Gunslinger Mastiff Puppy, and is subject to the refund terms and conditions of the Puppy Purchase Agreement (both Show Potential and Pet Quality) that has been provided with this Policy (provided either in writing, or as presented on the Gunslinger Mastiff Website). This includes the alternate puppy selected where the first choice was not available, as described in paragraph 3 (three) above.
5. There are 3 main reasons for this policy:
a. For the welfare of each puppy, it is the goal of Gunslinger Mastiffs to place each puppy by 8 weeks of age. As a result, Gunslinger Mastiffs may incur significant advertising costs to achieve this goal. Once a deposit is received, the puppy under deposit is no longer offered to the public at large, and we loose the opportunity to place this puppy elsewhere.
b. Gunslinger Mastiffs will spend the majority of their time for the 1st 3 - 4 weeks of the puppies' lives caring for them, and ensuring their good health. As a result, Gunslinger Mastiffs will loose this time to find an appropriate home for the dog under deposit.
c. This policy protects Gunslinger Mastiffs from potential buyers placing deposits on multiple puppies from different/multiple litters and breeders with the intent of backing-out on all but 1.
6. *** In the interest of fairness and good faith, Gunslinger Mastiffs will refund all or a portion of the deposit if the puppy originally under deposit is sold at, or prior to, 12 weeks of age. The refund will not be due until the puppy is physically sold and placed with their new family. If the puppy is not sold by 12 weeks of age, the deposit will not be refunded.
a. The amount of the refund will directly correlate to the proportionate amount of advertising spent to place the puppy.
i. For example, if Gunslinger Mastiffs spent $1,000.00 (one thousand dollars) in advertising on 10 puppies - including the puppy under deposit, you would be due back $400; because proportionately, we spent 1/10th - or $100 to advertise that puppy.
b. If no advertising was spent, then Gunslinger Mastiffs will refund the full $500, provided the criteria in paragraph 6 (six) above is met.
7. The Buyer and Breeder both agree that this is not an arbitrary contract, and that the venue and/or jurisdiction for any legal proceedings that arise from the result of this contract/Deposit Policy will be conducted in Bucks County, in the State and/or Commonwealth of Pennsylvania.
